Sir:
I have received information that makes me arrive from Oaxaca Mexico, with all attention me dirigo to you to express my preoccupation to him by the recurrence whereupon they are harassed and attacked the members and communities miembras of the Popular Indigenous Council of Oaxaca "Ricardo Flowers Magón" CIPO-RFM, particularly its representatives.
The balance from the creation of this organization of indigenous communities, 17 of November of 1997, has been but of 500 detenidos/as, and torturados/as near 100 incursions of the army, police and paramilitary to the communities of the organization, approximately 80 you order of apprehension to execute, 200 penal processes and of all type against agremiados/as, 37 threats of death to equal number of its members; 27 assassinated and 263 lesionados/as of gravity. At the moment, one of its known members but, Raul Gatica, practically lives hidden by the attempts of murder that has suffered. In San Isidro Aloapam, Yaviche, Lagunilla and Morelos Yosonotu, an indetermine number of their settlers live displaced on their community before the fear on being assassinated or being jailed by the only crime to organize itself for the defense of their rights like towns.
The 29 of April of 1999 the CNDH emitted to recommendation 26/99 the government of the state of Oaxaca. In June of the 2002, the CEDH emitted the 15/2002 and in March of 2004 a plus. Neither the national nor the state ones have been fulfilled. Still more, the CEDH has proposed single in this year 4 conciliations to the CIPO-RFM with the different police and still has the CIPO-RFM 22 complaints to be solved where the violations to their rights like community, organization and individuals are evident. On the other hand, it has but of 50 interposed penal denunciations against the aggressors of them, in some cases they are already ruined you order them of apprehension of the paramilitary ones but one does not stop to them, on the contrary, the paramilitary ones coexist with the police forces in the communities of Tanetze, San Miguel Aloapam and Sta, Lucia Monteverde.
In spite of all these tests the authorities do not make anything to guarantee the security of their citizens and on the contrary they threaten repressing them if they show its inconformidad, by the previous thing to you respectfully we let know:
a) that is required of its intervention to guarantee the application of justice and guarantees for physical integrity, psychological and moral of the members of the CIPO-RFM, the cancellation of you order them of apprehension of the common and federal law.
b) that is necessity to take care of the communitarian reclamations of health, house, use, schools, food, ways, respect to its mass media and projects like the transport, as well as to elaborate a plan of integral development with justice and dignity for the integral natives of the CIPO-RFM instead of repressing them.
c) which we are pending of the treatment and answer that they give to the natives of the CIPO-RFM in the day of protests which they initiate the 14 of June of the 2004, whose fundamental demands they are those of justice, solution to the agrarian conflicts, respect to its communitarian projects: radio, transport type suburban and access to beaches of Huatulco and Hidden Port, as well as respect to the rights of the democratic workers of the STSPEIDCEO.
